Renting in Valencia: Contracts, Deposits and What Landlords Can’t Ask

The short answer: A long-term rental for your main home in Valencia falls under Spain’s tenancy law (LAU). You can stay at least five years with an individual landlord, the deposit is capped at one month’s rent, and the landlord pays the agency fee. Annual rent rises are capped by an official index, the IRAV. Watch for a “contrato de temporada” on what is really your long-term home: it’s the most common way landlords sidestep those protections.

Finding a flat is, for most people, the hardest part of moving to Valencia. Prices have climbed fast, good listings go in days, and housing was back on the streets of the city this month. Spanish tenancy law gives you more protection than many people expect, though, and knowing it before you sign is the best leverage you have.

Courts look at the real situation, not the label. If you register on the padrón there, put utilities in your name and stay well past any “season”, a judge can treat it as a standard lease. If a landlord asks you to sign a temporada contract for what is clearly your home, ask why.

Red flags before you sign

  • Cash payments with no contract
  • A deposit above one month’s rent on a standard lease
  • Being asked to pay the agency’s fee yourself
  • A price that requires a transfer before you’ve seen the flat, in person or on a video call with someone you can verify
  • A refusal to give you a copy of the signed contract

What the market is like

Demand far outstrips supply, especially in central and beach-side neighbourhoods. Expect slow replies, and landlords collecting several applications before choosing. Have your documents ready before you start: proof of income, ID, a Spanish bank account if possible, and a short introduction about yourself.

Is Valencia a zona tensionada?

No. Under the 2023 housing law, a regional government can declare a “stressed market” area, which caps prices on new contracts. The Generalitat hasn’t declared any area in Valencia, unlike parts of Catalonia, the Basque Country, Navarra and Galicia. Some towns, such as Museros, have formally asked for it. National rules are also in flux: two emergency housing decrees approved on 29 September 2026, which included new rules for seasonal and room rentals, were voted down in Congress on 2 October. Getting your deposit back

A landlord can only keep money for damage beyond normal wear and tear, unpaid rent or bills, or a flat left seriously dirty. Scuffs and fading from ordinary living don’t count. Any deduction must be justified with photos and repair invoices.

Protect yourself from day one

  • Photograph the flat thoroughly on move-in and move-out day.
  • Pay rent by bank transfer and keep the records.
  • Put utilities in your name where possible.
  • Register on the padrón at the address as soon as you move in.

The same paper trail proves normal wear if a landlord overreaches on your deposit, and shows a court your real situation if a temporada label is ever challenged.

FAQ

How much deposit can a landlord ask for in Valencia? One month’s rent as the legal fianza on a standard housing lease, plus at most two more months in additional guarantees.

Do I have to pay the estate agent’s fee when renting? No. Since May 2023, the landlord pays the agency fee on a standard housing rental.

How much can my rent go up each year? If your contract was signed after 26 May 2023, by no more than the IRAV index the INE publishes each month. Older contracts follow the update clause in the contract, usually linked to inflation.
